That's the bugger of it, with such shoddy police work we don't even have a clue if he was or wasn't the actual criminal.  So... in essence, that monster whomever he may be, walks free

exactly.  even if they had the right guy, the cops screwed up.  in any event, there is still a violent criminal on the street.  I would hope that procedures in the US are better than they are in spain.
